First suit filed in Farallon yacht tragedy - SFGate: " . . . Bradford filed papers last month in federal court denying liability for any damages in the case, asserting a provision under admiralty and maritime law. The Busch lawsuit alleges that the crew should have known that breaking waves "which were tall enough, steep enough and powerful enough to capsize and wreck their vessel were likely to be rolling onto the 4-fathom shoal over which they were steering." It says Bradford and Capt. Alan Cahill are guilty of "outrageous conduct" because they "deliberately violated the manifest dictates of prudent seamanship." A report issued earlier this year by U.S. Sailing, the organization that oversees and regulates the sport of sailing, said crew members could have prevented the tragedy had they sailed in deeper water. . . . "
